a) If you visit our website www.elwema.de

Every visit to ELWEMA’s website and every retrieval of a file thereon will be recorded in an access log. In this regard, ELWEMA’s website service provider automatically collects and stores information in so-called server log files, which your browser automatically sends to ELWEMA.

These server log files include the following information:

  • Browser type/browser version of the terminal device accessing the site
  • Operating system used by the end terminal making the request
  • Referrer URL (the website visited beforehand),
  • IP address and host name of the computer/terminal device accessing the site,
  • Name of the website and file being requested,
  • Time of access and data volume, and
  • Date and time of the server request.

This data is processed by ELWEMA for the following purposes:

  • To ensure that a connection can be established with the site without issue,
  • To ensure that our website is convenient to use,
  • To publicly present the company with a high reach,
  • To ensure that the site can be found on the Internet by all stakeholders, including those who prefer to find information about our company via our social media channels,
  • To assess system security and stability, and
  • For further administrative purposes.

The legal basis for this data processing is Article 6(1f) General Data Protection Regulation (GDPR). The purposes listed above constitute our legitimate interests. We do not use the collected data for the purpose of drawing conclusions about you as an individual under any circumstances.

b) If you contact us using the contact form, or by e-mail, phone, fax or post

If you have any questions, we provide the option of contacting us using the contact form, phone, fax, e-mail or post.

When you contact us, we collect the data provided and, if applicable, other contact details (surname, first name, address, phone number and e-mail address) and the content of your inquiry in order to answer your inquiry.

If you use our contact forms, there is predominant legitimate interest in accordance with Article 6(1f) GDPR for publicity work, marketing purposes, information and for answering possible questions and similar from visitors. It is also possible that the data is processed for the purpose of entering into or fulfilling a contract in accordance with Article 6(1b) GDPR. The legal basis applicable to the processing of personal data via the contact form is shown under section 2c.

In all other respects, the data we process depends on the nature of your inquiry.

c) Data privacy for job applications and during the application process

We collect and process personal data of persons applying for employment at ELWEMA for the purpose of carrying out the application process and of carrying out and executing the employment relationship, should one enter into force.

The legal basis for this processing is Article 88 GDPR in conjunction with Section 26 German Federal Data Protection Act (BDSG). The data may be processed electronically as well as manually. This applies in particular if an applicant submits application documents to the us electronically, for example by e-mail or via a contact form on our website. If we enter into a contract with an applicant, the data transmitted for the purposes of establishing the contractual relationship is processed in accordance with legal regulations. The legal basis for this processing is also Article 88 GDPR in conjunction with Section 26 German Federal Data Protection Act (BDSG).

Your personal data is not transmitted to third parties for any purposes besides those listed below.

We only share your personal data with third parties:

  • If you have provided your express consent in accordance with Article 6(1a) GDPR,
  • If disclosure is necessary in accordance with Article 6(1f) GDPR for the establishment, exercise or defence of legal claims and there is no reason to believe that you have an overriding legitimate interest in the non-disclosure of your data,
  • In the event that there is a legal obligation underlying the disclosure in accordance with Article 6(1c) GDPR and
  • If it is permitted by law and necessary in accordance with Article 6(1b) GDPR for the execution of contractual relations with you or we have legitimate interest in accordance with Article 6(1f) GDPR and there is no reason to believe that you have an overriding legitimate interest in the non-disclosure of the data.
  • The data is disclosed in particular as part of our cooperation with external service providers that we work within the scope of the provision of our services.
  • For the use of our social media services within the scope specified in the section “4. Services provided by third parties”.
  • If, when opening the page, you have consented to transmitting data to Google for the purpose of displaying maps.

// Third-party services

Our website uses third-party content and services. This includes, for example, tools for displaying geographic maps and similar.

It is imperative for the provision of these services that the IP address is transferred from your terminal device to the third-party provider. Wherever possible, we have chosen the configuration that offers the highest level of conformity with data protection regulations. However, we have no influence over whether the IP address is stored.

Google Maps

At various points on our website, we use Google Maps (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) to display maps and to create route maps. By using this website, you agree to the data automatically collected and entered by you being recorded, processed and used by Google, its representatives or third parties.

If this is required by law or if third parties process this data on behalf of Google, Google may transfer the information obtained through Maps to third parties. It cannot be ruled out that Google may link your IP address to other data held by Google. It is technically possible for Google to be able to identify at least some individual users based on the data received. We have no influence over how Google processes personal data and personality profiles of website users for other purposes. You have the option of disabling the Google Maps service and thus preventing the transfer of data to Google. To do this, disable JavaScript in your browser. Please note that you cannot use the map display if you do this.

Facebook/Instagram

General information
ELWEMA maintains publicly accessible profiles on social networks.
Social networks such as Facebook, etc. can generally comprehensively analyse your user behaviour when you visit their website or a website with integrated social media content (e.g. “like” buttons or advertising banners). It cannot be ruled out that this may lead to further risks to you as a user.
If you visit one of our social media services (e.g. Facebook), you will trigger the processing of your personal data during such a visit. In this instance, we are jointly responsible with the operator of the relevant social network for these data processing operations within the meaning of Article 26 GDPR. If they offer their services to EU citizens, social networks are obligated to comply with the EU data protection standards. However, it cannot be ruled out that this processing may lead to risks in so-called third countries. ELWEMA does not use social media plug-ins, but it does use social bookmarks. These are only integrated into ELWEMA web pages as a link to the corresponding services. After clicking on the embedded picture, you will be taken to the relevant page of the relevant provider. If you visit our social media services, the relevant service provider will record your IP address and other information that is set on your terminal device or that already exists on your terminal device (computer, smartphone, tablet, or similar) in the form of cookies. // Deletion

We process and store your personal data as long as this is required to fulfil our contractual or legal obligations. It is important to note that our contractual relationship is designed as a long-term arrangement. If the data is deemed no longer necessary to fulfil contractual or legal obligations, the affected data will be deleted regularly, unless its (temporary) further processing is necessary for the following purposes:

  • To satisfy retention periods under commercial or tax law, such as the German Commercial Code or the Fiscal Code of Germany. The retention and/or documentation periods stipulated in these laws range from two to ten years.
  • To preserve evidence under a statute of limitations. In accordance with Sections 195 et seq. of the German Civil Code (BGB), these limitation periods are up to 30 years, with the regular limitation period lasting three years.

Data from persons who have applied for employment at ELWEMA will be deleted four months after the completion of the application process if no contract is entered into with the applicant, provided that no other legitimate interests on our part prevent such a deletion. An example of a legitimate interest would be a duty to provide evidence in legal proceedings under Germany’s General Act on Equal Treatment (AGG).

// Rights of the data subject

You have the right of access in accordance with Article 15 GDPR, the right to rectification in accordance with Article 16 GDPR, the right to erasure in accordance with Article 17 GDPR, the right to restriction of processing in accordance with Article 18 GDPR, the right to object in accordance with Article 21 GDPR, and the right to data portability in accordance with Article 20 GDPR. In addition, you have the right to lodge a complaint with a data protection supervisory authority (Article 77 GDPR in conjunction with Section 19 German Federal Data Protection Act [BDSG]).
