Data protection statement
On the website of ELWEMA Automotive GmbH (hereinbelow referred to as „ELWEMA“), certain personal data will be collected about you. ELWEMA deems it a matter of course and considers itself duty-bound to ensure that this data will be collected, processed and used exclusively in compliance with applicable data privacy law for purposes of contract handling and to safeguard its own legitimate business interests with a view to providing advice and support to users. For details regarding which data ELWEMA collects and how they are used by ELWEMA, please refer to the information given below:
Data collection and processing
Every visit to ELWEMA's website and every retrieval of a file presented thereon will be recorded in an access log. The storage of these log data merely serves internal system-related and statistical purposes relating to the operation, security and optimization of ELWEMA's website. In this context, information is stored automatically in so-called server log files by ELWEMA's website provider and will be automatically transmitted to ELWEMA by your browser. Such server log file data include the following:
• browser type / browser version of the user's terminal equipment
• operating system of the user's terminal equipment
• referrer URL (i.e., the previously visited website)
• IP address and host name of the accessing computer/terminal equipment
• name of the accessed website/page and requested file
• access time and volume of data accessed
• date and time of server request.
This data cannot be associated with any specific person. Moreover, it will not be merged with data from other data sources. ELWEMA reserves the right to have this data audited retroactively if ELWEMA obtains specific evidence indicating unlawful use.
Use and transfer of personal data
ELWEMA uses your personal data – i.e., pursuant to section 3(1) of the Federal Data Protection Act, individual information about the personal and material circumstances of an identified or identifiable natural person which, under current case law, is deemed to include IP addresses – solely for purposes of contract handling and technical administration. Your personal data will not be transferred to any third parties except where this is required for contract handling or invoicing purposes or if you have expressed prior consent. You may revoke such consent, once given, at any time with effect for the future by email to info@elwema.de. Stored personal data will be erased if you revoke your consent to storage and processing thereof, if having knowledge thereof is no longer necessary for accomplishing the purpose for which they were stored, or if their storage is no longer permitted for other legal reasons.
Users who have disclosed their phone number and/or email address and/or further contact data to ELWEMA and have separately consented to the lawful use of such personal data for ELWEMA's own advertising purposes, may be contacted by ELWEMA by email or post to receive information about specific offers. The user may unsubscribe from receiving such information at any time by sending a message to that effect to ELWEMA's email address stated above.
Contact data (e.g., name, address, phone number or email address) transmitted or communicated via ELWEMA's website as part of an enquiry, e.g., through the contact form or by email, will be stored at ELWEMA for the purpose of processing the enquiry and any future queries. ELWEMA will not disclose this data to others without permission.
Contact by e-mail
E-mails including their content are forwarded in-house to the processor's desk and processed there. Since most e-mail needs to be archived with its content under the provisions of the Fiscal Code, we will archive e-mail in compliance with legal requirements (for up to 10 years). This is done using a storage system which saves e-mail content in a compressed form. Since it is impossible to distinguish in terms of content between e-mails handled, we explicitly point out that job application e-mail and private e-mail may come under this permanent storage and archiving process as well. We therefore request you to refrain from sending e-mail of a private nature. As to job applications, please refer to the section entitled "Application by e-mail”.
It is pointed out that unencrypted email sent via the internet is not adequately protected from unauthorized third-party access. Such email generally does not constitute a technically safe communication channel. ELWEMA recommends encryption or the use of postal services for transmitting confidential information.
Applications and application process
We collect and process applicants' personal data for purposes of handling the application workflow. Processing may be carried out by various, including electronic, means. This holds true particularly if you, as an applicant, submit the relevant application documents to us electronically, e.g., by e-mail. In case we conclude an employment contract with you, the data transmitted will be stored in our system for purposes of managing the employment relation in accordance with the law. If no employment contract is concluded with you, the application documents will be deleted no later than two months from the announcement of the rejection decision, unless such deletion would contravene any other legitimate interests. The latter might include, e.g., an accountability obligation (burden of proof) in proceedings under the General Equal Treatment Act (AGG) or the like.
Application by e-mail
In the case of an electronic application process based on e-mail the data will be printed out once and then forwarded in-house to the heads of the relevant departments who are (co-)responsible for deciding on your application. Our staff involved in the application process is specially trained, explicitly bound to confidentiality, and under instructions not to duplicate your application. Once a final decision has been taken, the documents will be returned to the Human Resources unit where it will be destroyed in a data-safe manner.
Application by hardcopy
In the case of an application process based on paper documents (hardcopy), the data will be forwarded in-house to the heads of the relevant departments who are (co-)responsible for deciding on your application. This may require copying your documents, or parts thereof. Our staff involved in the application process is specially trained, explicitly bound to confidentiality, and under instructions not to duplicate your application further. In view of accountability obligations we shall retain your application for the above-mentioned period. Thereafter, any potential copies of your application documents will be destroyed in a data-safe manner (by passing them through a shredder). Your original documents will be returned to you to relieve us of any further responsibility.
Under this Data Protection Statement
a) the user consents to the collection, processing and use of personal data by ELWEMA to the extent required to enable him/her to use this internet offering;
b) ELWEMA takes the protection of personal user data very seriously and undertakes to respect the user's privacy. However, for ELWEMA to be able to provide the performance owed to the user, the collection and use of certain personal data is necessary;
c) ELWEMA shall use user data solely for purposes of statistics and technical administration. For any other purpose, user data shall be employed only with the user's specific permission. User data shall not be passed on to third parties, except if and when necessary to provide this internet offering;
d) users are entitled under section 34 of the Federal Data Protection Act (BDSG) to request information about their stored data from ELWEMA. Moreover, users have the right, to the extent set forth in section 35 BDSG, to demand that ELWEMA correct, erase or block their personal data.

e) the user consents, by visiting ELWEMA's website, to the placement of a cookie in his computer. A cookie is a small text file sent to the user's browser by a web server and subsequently stored on his/her hard drive. ELWEMA has no way of identifying a user via a cookie. ELWEMA can merely gain information, from a user's visit, about how that user uses its site (e.g., page views, date and time of visit, etc.). Needless to say, a user can reject the placement of cookies by changing his/her browser settings accordingly; however, the functions of ELWEMA's website may be partially restricted in this case. Also, the user is free to erase cookies individually at any time. For information on how to do this, the user should consult the Operating Instructions for his/her computer and browser.
f) it is pointed out that ELWEMA Automotive GmbH's website uses a plug-in by LinkedIn, the social network operated by LinkedIn Corp., 2029 Stierlin Court, Mountain View, CA 94043, USA (hereinbelow referred to as "LinkedIn"). The plug-in and/or button, respectively, can be identified by the LinkedIn logo or the "Recommend" button. When a user visits ELWEMA Automotive GmbH's website, a direct connection between the user's browser and the LinkedIn server is set up via the plug-in. As a result, LinkedIn receives the information that the user has visited ELWEMA Automotive GmbH's website from his/her IP address. By clicking on the LinkedIn "Recommend" button, a user who is simultaneously logged on to LinkedIn via his/her personal user account at the time of accessing ELWEMA Automotive GmbH's website can link the contents of ELWEMA Automotive GmbH's website to his/her LinkedIn profile. LinkedIn can thereby associate the visit to ELWEMA Automotive GmbH's website with the user's user account. This association capability can be disabled by logging out of the user's personal user account beforehand. g) it is pointed out that ELWEMA Automotive GmbH's website uses a plug-in by XING, the social network, provided by XING AG, Gänsemarkt 43, 20354 Hamburg, Germany (hereinbelow referred to as „XING“). The plug-in used can be identified by the XING logo and/or the XING "Share" button, respectively. When a user visits ELWEMA Automotive GmbH's website via his/her browser, a connection to XING's servers is set up. As a result, the Share functions (e.g., display of the counter value) will be executed. No storage of personal data relating to the user's access to ELWEMA Automotive GmbH's website will be effected thereby. In particular, XING will not store IP addresses. The user's usage patterns will not be analyzed, either. Current data protection information concerning the "Share" button and other information relevant in this context are made available to users by XING at https://www.xing.com/app/share?op=data_protection.
h) it is pointed out that ELWEMA Automotive GmbH's website uses a plug-in by kununu, the social network, provided by kununu GmbH (a subsidiary of XING AG), Wollzeile 1-3 Top 5.1, 1010 Vienna, Austria (hereinbelow referred to as "kununu"). The plug-in used can be identified by the kununu logo and/or the kununu "Share" button, respectively. When a user visits ELWEMA Automotive GmbH's website via his/her browser, a connection to kununu's servers is set up. As a result, the Share functions (e.g., display of the counter value) will be executed. No storage of personal data relating to the user's access to ELWEMA Automotive GmbH's website will be effected thereby. In particular, kununu will not store IP addresses. The user's usage patterns will not be analyzed, either. Current data protection information concerning the "Share" button and other information relevant in this context are made available to users by kununu at http://www.kununu.com/info/datenschutz.
i) it is pointed out that ELWEMA Automotive GmbH's website uses a plug-in by Facebook, the social network, that is operated and provided by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (hereinbelow referred to as "Facebook"). The plug-in used can be identified by the Facebook logo and/or the supplementary "Like" button, respectively. If the user is also a Facebook user and is simultaneously logged on to Facebook via his/her personal user account at the time of accessing ELWEMA Automotive GmbH's website, the user's browser will connect directly to Facebook's servers and will communicate and store the information that the user has invoked and visited ELWEMA Automotive GmbH's website. If the user is not a member of Facebook, it is possible that Facebook will ascertain and store his/her IP address nevertheless. According to Facebook, only an anonymized IP address will be stored in Germany. If the user is logged on to Facebook as a user at the time of accessing ELWEMA Automotive GmbH's website, this information is going to be directly associated with his user account by Facebook.
